PREAMBLE

PHNTM One is a personal assistant that lives entirely on the device you
bought. I built it on one promise: nothing you say leaves the box. A promise
like that is only worth something if you can check it, so the software on
your PHNTM One ships as readable source code, on the device, under this
license. You are meant to open it, read it, and verify for yourself that it
does what I say it does.

This license gives you those rights — and reserves the rest, because PHNTM
One is also how I make a living. Read it; it is short and written in plain
language on purpose. Where it says "you", it means the owner of a PHNTM One
device or anyone else who has received this software. Where it says "the
Software", it means the PHNTM One application code and the files that ship
with it in this repository, but NOT the third-party components listed in
Section 6.

1. WHAT YOU MAY DO

  a. Read and study. You may read, study, search and audit every file of the
     Software on any PHNTM One device you own, and keep copies for that
     purpose.

  b. Modify and run on your own device. You may modify the Software and run
     your modified version on any PHNTM One device you own. It is your
     device; I will not tell you what to run on it.

  c. Share for discussion. You may quote or reproduce portions of the
     Software for the purpose of reviewing it, reporting a security issue,
     teaching, or discussing it publicly — including in a video, article or
     talk — provided you attribute it to PHNTM One.

  d. Security research. You may analyze the Software for vulnerabilities
     and publish what you find. I ask only that you give me a reasonable
     chance to fix a serious issue before disclosing details that would put
     other owners at risk.

  e. Back up and restore. You may copy the Software as part of backing up,
     restoring, re-imaging or repairing your own PHNTM One device.

2. WHAT YOU MAY NOT DO (WITHOUT MY WRITTEN PERMISSION)

  a. Redistribute. You may not distribute the Software, or any substantial
     part or derivative of it, to anyone else — on hardware, as a download,
     as a service, or otherwise — except as allowed in Section 1.

  b. Sell or ship it. You may not load the Software, modified or not, onto
     hardware that you sell, rent, give away or otherwise provide to others,
     and you may not offer it as a hosted service.

  c. Use the name or marks. You may not use the names "PHNTM", "PHNTM One",
     the PHNTM mark, or the phntmcore.com domain to describe a product,
     service or build that I did not make, or in a way that suggests I
     endorse it. Honest reference ("I run a modified PHNTM One") is fine.

  d. Remove notices. You may not remove or alter this license, the copyright
     notice, or the third-party notices in NOTICE and docs/licenses/.

3. OWNERSHIP

The Software is licensed, not sold. I retain all right, title and interest
in it, including all copyright. Your rights are exactly those granted above;
everything else is reserved. Modifications you make for your own device are
yours to keep; you do not have to share them with me, and if you do send
them to me, you grant me permission to use them in PHNTM One without
obligation to you.

4. YOUR DATA

This license is about the code, not about you. Your conversations, memories,
documents and settings are your data and stay on your device. I do not have
servers that see them, I do not have a copy, and nothing in this license
gives me any right to them. The PHNTM One privacy statement, shipped on the
device, describes exactly what the Software does and does not send.

5. NO WARRANTY; LIMITATION OF LIABILITY

I built PHNTM One carefully and I stand behind it as a product, but as a
matter of law the Software is provided "AS IS", WITHOUT WARRANTY OF ANY
KIND, express or implied, including the implied warranties of
merchantability, fitness for a particular purpose, title and
non-infringement. An AI assistant can be wrong; do not rely on its answers
for medical, legal, financial or safety decisions without checking them.

To the fullest extent permitted by law, I will not be liable for any
indirect, incidental, special, consequential or punitive damages, or for any
loss of data, profit or use, arising out of or related to the Software or
this license, even if advised of the possibility of such damages. My total
liability for any claim arising out of the Software will not exceed the
amount you paid for the PHNTM One device on which it runs. Some
jurisdictions do not allow these limitations; in those places they apply
only to the extent permitted. This section does not limit any warranty or
remedy that comes with the hardware itself or that applicable consumer law
does not allow to be excluded.

6. THIRD-PARTY COMPONENTS

The Software runs alongside third-party software and machine-learning
models — including Llama 3.2 (Meta), Gemma 3 (Google), nomic-embed-text,
Piper, whisper.cpp, Ollama, Firefox ESR, Debian, and Python libraries. Those
components are NOT covered by this license. Each is provided under its own
terms, which ship on the device in NOTICE and docs/licenses/ and which you
must follow. In particular, the chat models are subject to the Llama 3.2
Community License and the Gemma Terms of Use, including their acceptable-use
and prohibited-use policies.

7. TERMINATION

This license ends automatically if you breach Section 2 and do not cure the
breach within 30 days of my notice to you. Sections 3, 5 and 6 survive
termination. Ending this license does not affect your ownership of the
hardware.

8. GENERAL

This license is governed by the laws of the State of Kansas, United States,
without regard to its conflict-of-law rules, and any dispute will be heard in
the state or federal courts located in Kansas; if you are a consumer, you keep
any protections the law of your own home jurisdiction gives you that cannot
be waived. If any part of this license is found unenforceable, the rest
stays in force. This is the whole agreement between you and me about the
Software; it does not change the terms that came with your hardware
purchase. I may publish updated versions of this license for future
releases; the version that ships on your device is the one that applies to
it.
